1. Definitions

  • “We / Us / Our” refers to Giovanna Motors Ltd.
  • “Customer / You” refers to any individual or business using our services or purchasing a vehicle.
  • “Vehicle” means any motor vehicle, parts, or accessories.
  • “Services” include repairs, servicing, diagnostics, MOT preparation, inspections, and related work.

2. General

2.1 These Terms & Conditions apply to all vehicle sales, servicing, repairs, and related services carried out by us.
2.2 By using our services or purchasing a vehicle, you agree to be bound by these Terms & Conditions.
2.3 No employee or agent has authority to vary these terms unless confirmed in writing by management.

3. Vehicle Sales (Used Vehicles)

3.1 Vehicle Condition

  • All used vehicles are sold as seen, tried, and tested, subject to statutory consumer rights.
  • We strongly recommend customers inspect and test-drive vehicles prior to purchase.
  • Mileage, age, and general wear are consistent with the vehicle’s age unless otherwise stated.

3.2 Consumer Rights

  • Nothing in these Terms limits your rights under the Consumer Rights Act 2015.
  • If a vehicle is faulty or misdescribed, your statutory rights apply.

3.3 Deposits

  • Deposits are non-refundable unless we cancel the sale or fail to supply the vehicle as described.
  • Deposits reserve the vehicle for a limited time only, agreed at point of sale.

3.4 Payment & Ownership

  • Full payment must be made before vehicle collection.
  • Ownership passes to the customer only once full cleared payment has been received.

3.5 Warranty

  • Any warranty offered will be provided in writing.
  • Warranty does not cover:
    • Fair wear and tear
    • Consumables (e.g. tyres, brake pads, bulbs)
    • Damage caused by misuse, neglect, or accident
    • Modifications or repairs carried out by third parties

3.6 Part Exchange

  • Any part-exchange valuation is conditional upon accurate description.
  • We reserve the right to revise or withdraw valuation if undisclosed faults are found.

4. Servicing & Repairs

4.1 Authorisation

  • By leaving your vehicle with us, you authorise us to carry out agreed work.
  • Any additional work required will be discussed and authorised before proceeding where reasonably possible.

4.2 Estimates

  • Estimates are provided in good faith and are not fixed quotations unless stated in writing.
  • Final costs may vary if additional faults are discovered.

4.3 Completion Times

  • Completion times are estimates only.
  • We are not liable for delays caused by parts availability, third parties, or unforeseen issues.

4.4 Customer Responsibilities

  • You must disclose known faults, warning lights, or previous repairs.
  • We are not responsible for pre-existing faults discovered during repair.

5. Parts & Labour

  • New, reconditioned, or used parts may be used unless otherwise agreed.
  • Removed parts remain our property unless requested at the time of authorisation.
  • Labour warranties (if offered) apply only to work carried out by us.

6. MOT Testing

  • MOT tests are conducted in accordance with DVSA regulations.
  • A pass certificate does not guarantee the future condition of the vehicle.
  • We are not responsible for faults developing after the test.

7. Storage & Collection

7.1 Vehicles must be collected within 24 hours of completion unless agreed otherwise.
7.2 Storage charges may apply after this period.
7.3 Vehicles left uncollected for extended periods may be disposed of to recover costs, in line with the Torts (Interference with Goods) Act 1977.

8. Payment Terms

  • Payment is due immediately upon completion of work or prior to vehicle release.
  • We reserve the right to retain vehicles until payment is made in full.
  • Late payments may incur additional charges.

9. Liability

9.1 We are not liable for:

  • Loss or damage to personal belongings left in vehicles
  • Indirect or consequential losses
  • Mechanical failures occurring after repair unless directly caused by our negligence

9.2 Our liability is limited to the value of the work carried out or vehicle sold, except where prohibited by law.

10. Roadworthiness

  • Responsibility for ensuring a vehicle is roadworthy rests with the owner at all times.
  • Advice or repairs carried out do not guarantee long-term safety or compliance.

11. Complaints

  • Complaints should be raised as soon as possible.
  • We will make reasonable efforts to resolve disputes amicably before legal action.

12. Data Protection

  • Customer data is handled in accordance with UK GDPR and the Data Protection Act 2018.
  • We do not share customer data except where legally required.

13. Governing Law

  • These Terms & Conditions are governed by the laws of England and Wales.
  • Any disputes will be subject to the jurisdiction of the English courts.

14. Amendments

  • We reserve the right to update these Terms & Conditions at any time.
  • The latest version will apply to all future transactions.
